Not fan art that has titties showing. Raita for example has a ban on doing Valkyria Chronicles stuff that involve nudity, the furthest he can go are swimsuits.

We can only assume that, for whatever reason, the creator of Gate is a lot more lenient about this sort of thing.

Or when he (the artist) was contracted to make the Gate manga the people doing the contract probably forgot that clausal, or didn't think it was needed.

Its like the case of Taka Tony not drawing outright nude art of Shining game series characters he designed & Nakajima Yuka of DL Action doujins drawing nude pics of the characters she designed for official Light Novels as well.
If they wanted to I think they had to be discrete about it or use different "anonymous" pen names or something.
