Partially averted in Electric Tale of Pikachu at least as I recall: I seem to remember Ash having to pass a test to get licensed as a pokemon trainer. Of course with just one test you can wield a pikachu...and gyarados, and ursaring, and salamence, and the anything else you want...

Not to mention the fact that, apprently, in Pokeworld having a 5-6th grade education (appx.) is considered sufficent to "go out into the world" and live more or less on your own for months on end. I sure as hell wouldn't have been able to fend for myself at 10 (I knoew there are people who could, but in Pokeworld it must be the norm) Let's face it, if Pokemon were real in all probablity the only people who'd be allowed to raise and train them would be fully grown, heavily trined and certified adults who would probably need a seperate certification for each species. Okay maybe a few of the "pet based" species (meowth, growlithe etc) would be permitted but not neccecarily (I doubt as may parents would let thier kids have a dog if the dog could breathe fire) I also think that if Pokemon were real there'd be something equivalent to PETA, someone would start saying that capturing wild Pokemon and making them fight each other was animal cruelty.
